Terms of Use

These Terms of Use (“Terms”) govern your use of the SurfIQmobile app and this website (together, the “Service”), operated by Iadherence Inc. By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
Surf conditions are estimates, not guarantees
SurfIQ produces forecasts and recommendations from modelled and third-party marine data. Ocean conditions change quickly and can differ substantially from any forecast. The Service is not a safety device and must not be relied on as one. You are solely responsible for assessing conditions, your own ability, and local hazards before entering the water, and for complying with local rules, closures, and warnings.
Eligibility and your account
You must be at least 13 years old to use the Service. You are responsible for the accuracy of the information you provide, for keeping your account credentials secure, and for activity that occurs under your account. Tell us at oldmansreport@gmail.com if you believe your account has been compromised.
Acceptable use
You agree not to:
- Break the law, infringe anyone’s rights, or violate anyone’s privacy.
- Harass, threaten, impersonate, or abuse other people, or post content that is objectionable, hateful, sexually explicit, or violent.
- Upload malware, scrape the Service, or attempt to breach or overload our systems.
- Resell, redistribute, or build a competing forecasting product from data obtained through the Service.
Community content
SurfIQ lets you post messages and images and connect with other people. You remain responsible for what you post. We do not tolerate objectionable content or abusive behavior: you can report content and block users from within the app, we review reports of abuse, and we may remove content and suspend or terminate accounts that violate these Terms — in serious cases, without notice.
You keep ownership of the content you post. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely to operate and improve the Service, including delivering it to the people you share it with. This license ends when you delete the content or your account, except for copies retained in routine backups.
Our intellectual property
The Service, including its software, models, design, and branding, belongs to Iadherence Inc. and its licensors. We grant you a personal, non-transferable, revocable license to use the app for your own non-commercial use. Nothing in these Terms transfers ownership to you.
Third-party data and services
The Service incorporates data and infrastructure from third parties, including marine forecast data providers and hosting providers. We do not control that data and do not warrant its accuracy, completeness, or availability.
Termination
You may stop using the Service at any time and request deletion of your account by contacting oldmansreport@gmail.com. We may suspend or terminate access if you violate these Terms or if we discontinue the Service.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that forecasts will be accurate.
Limitation of liability
To the fullest extent permitted by law, Iadherence Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of — or inability to use — the Service. This includes injury or loss connected with surfing or other activity undertaken in reliance on a forecast. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD 50.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Apple App Store
If you obtained the app from the Apple App Store, you acknowledge that these Terms are between you and Iadherence Inc. — not Apple — and that Apple has no obligation to provide support or maintenance for the app. Apple is a third-party beneficiary of these Terms and may enforce them against you.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date above; continuing to use the Service after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules.
